$500K Settlement Obtained in Wrongful Death Case Against a California Nursing Home

Garcia & Artigliere elder abuse attorney Stephen M. Garcia obtained a $500,000 settlement on behalf of the son of an elderly woman who suffered elder abuse and neglect while a resident at a California skilled nursing facility, which later led to her death.

In July 2018, the Plaintiff was admitted to the facility for rehabilitation for a fractured hip. According to the lawsuit, the nursing facility failed to provide the Plaintiff with the medical care she required, which included keeping her clean and dry, turning her in bed to relieve pressure, and providing her with adequate nutrition and hydration to stave off skin breakdown. The facility’s failure to follow the Plaintiff’s plan of care led to an avoidable Stage IV pressure ulcer on her elbow, which nurses concealed from the Plaintiff’s family and physician. As a proximate result of this neglect, the Plaintiff died on November 3, 2021.

The Plaintiff suffered these injuries because facility staff simply did not have adequate time or the inclination to provide her with required care and to document and address her emergent conditions. These injuries were entirely preventable had there been sufficient staff on duty, in both number and competency.
