$800k Settlement Obtained Against Topanga Nursing Home for Unfair and Deceptive Business Practices

Garcia & Artigliere elder abuse attorneys Stephen Garcia and Rosalie Baladejo obtained a $800,000 settlement on behalf of the Plaintiff, an elderly woman, who was misled and suffered financial hardships due to the unlawful business practices at a Topanga, California skilled nursing facility.

During the admissions process and prior to becoming a resident, facility staff presented the Plaintiff with a standard admission agreement containing the resident bill of rights, and the Plaintiff signed the agreement without knowledge the facility was not equipped to provide mandatory care to its residents. The lawsuit asserted that the facility was chronically understaffed and because the Defendants were illegally siphoning off required funds for resident care, this left insufficient funds to safely and lawfully operate the facility. Had the Defendants been transparent about their business practices, the Plaintiff would not have become a resident or paid substantial money for the facility’s substandard care.
