$835K Settlement Acquired Against a Southern California Nursing Home for Elder Abuse

Garcia & Artigliere elder abuse attorneys Stephen M. Garcia and William M. Artigliere secured an $835,000 settlement for their elderly client D.G. who suffered an avoidable stage IV bedsore and fall due to the neglect of a Southern California skilled nursing facility.

Upon admission to the facility, D.G. suffered from dementia, severe osteopenia and obesity, among other ailments, which required special care and assistance, including 24-hour supervision and monitoring. Facility staff were well aware through assessment information, family information as well as physician notes and orders that D.G. was a high risk for falls and needed assistance and monitoring with activities of daily living. Yet, the nursing home consistently ignored these needs and D.G. developed a severe, infected stage IV pressure ulcer and suffered a preventable fall with a fracture that was concealed for months. D.G.’s durable power of attorney was never provided an explanation as to how the fall occurred.
