$499K Settlement Obtained Against California Residential Care Facility for Elder Abuse

Garcia & Artigliere elder abuse attorneys Stephen M. Garcia and Rosalie Baladejo obtained a $499,000 settlement on behalf of their Plaintiff, an elderly man who suffered an inoperative brain bleed following a preventable fall which occurred due to the negligence of a California Residential Care Facility for the Elderly.

The Plaintiff was admitted to the facility suffering from Alzheimer’s and had been placed on Seroquel and Zantac for his condition. However, despite the known risk of falls associated with these medications, facility staff ignored this danger and failed to enact preventative measures. As a result, the Plaintiff suffered two falls, with the second fall resulting in an inoperative brain bleed. He was placed on hospice care and died just a few days later.
