$3M Jury Verdict Secured in Elder Abuse Lawsuit Against a Kentucky Skilled Nursing Home

Garcia & Artigliere elder abuse attorneys Stephen M. Garcia and Matthew M. Coman obtained a nearly $3.1 million jury verdict on behalf of Linda Elias, an elderly woman who suffered significant injuries while admitted to the Parkway Extended Care skilled nursing facility in Louisville, Kentucky. Ms. Elias entered Parkway with a fractured hip, spinal compression fractures and osteoarthritis. Due to the facility’s persistent failure in appropriately managing Ms. Elias’ health conditions, she developed a pressure injury on her heel and endured severe contractures, suffered from feeding tube issues, and her pain medication regimen was improperly managed. In a multi-week trial, Garcia & Artigliere proved the Defendants were negligent in providing proper care and treatment to Ms. Elias from 2010 until her death in February 2015. Notably, the jury awarded $3 million in punitive damages for the Defendants’ negligence. The Defendants were represented by John L. Tate and Neil E. Barton of Sites & Harbison, PLLC in Louisville, Kentucky.
