Garcia & Artigliere Files Dependent Adult Abuse Claim Against Gretchen Manor

Under California health laws, non-medical residential care facilities for the elderly (RCFEs) are obligated to provide a humane housing situation for dependent adults – and to refrain from accepting residents who require a higher level of medical care than they can offer. The decedent was first admitted to Gretchen Manor in February 2019 after a stay at Country Villa Wilshire Healthcare Center, a skilled nursing facility. In need of 24-hour skilled nursing care and constant assistance with activities of daily living (ADLs), the decedent suffered from conditions that increased her risk of death and injury by choking.

In spite of these facts, Gretchen Manor care facility still admitted the decedent as a resident, exposing her to severe health and safety hazards. As her physical and mental condition continued to deteriorate, the facility staff did not observe her family’s request to feed her in the public dining room, instead leaving her to eat in private during mealtimes. On January 10, 2020, the decedent suffered a severe choking incident without qualified staff nearby and died as a result.

By leaving the decedent without proper care in spite of her condition, the staff and owners at Gretchen Manor care facility showed a high degree of negligence.
