$750,000 Settlement Achieved in Elder Abuse Lawsuit Against a Northern California Acute Care Facility

Garcia & Artigliere elder abuse attorney Stephen M. Garcia obtained a $750,000 settlement on behalf of their elderly client R.M. who had been placed in a Northern California Board and Care and as a result of the facility’s reckless neglect, suffered from multiple stage III and IV pressure ulcers, malnutrition, pneumonia and sepsis which led directly to his death.

R.M. was admitted to the facility in 2014 because he was wheelchair bound and needed additional assistance with activities of daily living. From June 2020 to October 2020, R.M.
developed horrific pressure sores from his spine to his hips, malnutrition resulting in a thirty-pound weight loss requiring a G-Tube and suffered from pneumonia and sepsis. His niece was unable to visit the facility during this time due to COVID-19 restrictions but would regularly call to check on R.M.’s condition and despite his significant health conditions, was told he was fine.

Finally, in late October 2020, a staff member contacted R.M.’s niece to advise that he was ill and would be treated at the facility. His niece insisted that R.M. be treated at a hospital and he was transferred. Following his admission, hospital staff contacted the California Department of Social Services to report the facility’s abuse of R.M. A few weeks later, R.M. was transferred to another hospital where he died on November 13, 2020.
