Common types of nursing home negligence

Understaffing and neglect are serious concerns at facilities like Wolfe County Health & Rehabilitation Center, often leading to dangerous consequences for residents:

  • Insufficient staffing can result in residents not receiving adequate nutrition and hydration, increasing the risk of severe health complications.
  • Poor hygiene and prolonged immobility can cause pressure ulcers (bedsores) and infections.
  • Overburdened staff may administer incorrect medication dosages or fail to provide necessary medications on time, putting residents' health at risk.
  • A lack of proper supervision raises the likelihood of falls, which can lead to fractures, head injuries, and long-term disabilities.

Both federal and state laws require skilled nursing facilities to provide sufficient and competent nursing staffing to meet the needs of their census populations.  The federal Centers for Medicare & Medicaid Services (“CMS”) monitor and regulate skilled nursing facilities and their various staffing levels.

In its regulatory role, CMS created the Five-Star Rating System1 that calculates various quality measures based on the data that each facility provides to CMS as part of their respective participation in the Medicare program.

According to CMS, “[n]ursing homes with 5 stars are considered to have much above average quality and nursing homes with 1 star are considered to have quality much below average.”2  On October 24, 2019, the Wolfe County Health & Rehabilitation Center, located at 850 Hwy 191, Campton, Kentucky 41301, was cited when “[t]he facility failed to conduct an accurate . . .  assessment for [a resident].”3
