Both federal and state laws require skilled nursing facilities to provide sufficient and competent nursing staffing to meet the needs of their census populations. The federal Centers for Medicare & Medicaid Services (“CMS”) monitor and regulate skilled nursing facilities and their various staffing levels.
In its regulatory role, CMS created the Five-Star Rating System1 that calculates various quality measures based on the data that each facility provides to CMS as part of their respective participation in the Medicare program.
According to CMS, “[n]ursing homes with 5 stars are considered to have much above average quality and nursing homes with 1 star are considered to have quality much below average.”2 Notably, among the most significant factors reviewed by CMS is that “staffing” provided to each facility’s census population. Based on the data provided to CMS, CMS has determined that Barbourville Health and Rehabilitation Center, located at 65 Minton Hickory Farm Road in Barbourville, Kentucky 40906, garnered an Overall 1 Star rating, which ranks at the bottom of the scale and is defined as “much below average.”3 On September 3, 2024, this facility was cited when the facility failed to “[t]imely report suspected abuse, neglect, or theft and report the results of the investigation to proper authorities[,]” “[f]ailed to ensure a thorough investigation was completed for an injury of unknown origin[,]” “failed to have an effective system to ensure care plans were revised to provide for necessary interventions and monitoring for residents to prevent falls/accidents[,]” and “[f]ailed to ensure it was administered in a manner that enabled it to use its resources effectively and efficiently to attain or maintain the highest physical, mental, and psychosocial well-being of each resident for the management of falls[.]”4
