Both federal and state laws require skilled nursing facilities to provide sufficient and competent nursing staffing to meet the needs of their census populations.  The federal Centers for Medicare & Medicaid Services (“CMS”) monitor and regulate skilled nursing facilities and their various staffing levels.  In its regulatory role, CMS created the Five-Star Rating System[1] that calculates various quality measures based on the data that each facility provides to CMS as part of their respective participation in the Medicare program.  According to CMS, “[n]ursing homes with 5 stars are considered to have much above average quality and nursing homes with 1 star are considered to have quality much below average.”[2]  Notably, among the most significant factor reviewed by CMS is that “staffing” provided to each facility’s census population.  Based on the data provided to CMS, CMS has determined that Baton Rouge Health Care Center located at 5550 Thomas Road, Baton Rouge, Louisiana 70811 garnered a 1 Star for staffing, which ranks at the bottom of the scale and is defined as “much below average.”[3]  On August 23, 2023, this facility was cited when “[t]he facility failed to ensure resident assessments accurately reflected the resident’s status.”[4]  On July 6, 2023, this facility was cited when “[t]he facility failed to ensure residents received treatment and care in accordance with professional standards of practice and the comprehensive person-centered care plan[,] when “[t]he facility failed to ensure Licensed and Registered Nurses had the specific competencies and skill sets necessary to care for resident’s needs, as identified through resident assessments, and described in the plan of care[,]” and when “[t]he facility failed to be administered in a manner that enabled it to use its resources effectively and efficiently to attain or maintain the highest practicable physical, mental, and psychological well-being of each resident.”[5]
