Successes:Favorable Outcome for Accidental Death in Unauthorized Blood Transfusion
Elder abuse attorney Stephen M. Garcia obtained a successful outcome for an 82-year-old woman who after undergoing surgery for a hiatal hernia in a community hospital was transferred to a convalescent hospital for aftercare. Due to an untreated staph infection at the surgical site, the woman went into septic shock and was readmitted back into the community hospital.
The hospital staff mixed up the order for a blood transfusion for another patient and gave it to the 82-year-old woman. On her death certificate, the coroner declared the cause “accidental death due to unauthorized blood transfusion.”
