Pine Creek Care Center Sued for Elder Abuse and Negligent Hiring
Garcia, Artigliere & Medby filed a lawsuit in San Diego Superior Court accusing Pine Creek Care Center of elder abuse and negligence. The facility’s inattention caused an elderly patient, Cleo Holman, to develop a severe pressure ulcer on her body.
“There are certain levels of care nursing facilities are required to give,” said Attorney Stephen Garcia. “The facility and its staff did not even provide the bare minimum, and as a result, Cleo suffered severely.”
Ms. Holman was admitted to Pine Creek Care Center in October 2015 after falling and breaking her hip. She required assistance with daily living activities, including eating, grooming, using the bathroom and taking daily medication, among other things. As a result of her fractured hip, she also needed to be rotated every two hours to make sure pressure sores did not develop.
The staff routinely neglected Ms. Holman’s personal care, which included: leaving her to sit in her urine and feces for extended periods of time; failing to provide assistance with any personal hygiene; failing to provide adequate nutrition; failing to rotate her body regularly; and ignoring the doctor’s recommendations for her care. In addition to providing poor care and failing to reposition Ms. Holman periodically, the staff overmedicated her with sedatives, increasing her sedentary nature.
As a result of the facility’s carelessness, Ms. Holman developed a severe pressure ulcer that became so infected she had to be transported to the hospital for treatment. The staff’s negligence led to Ms. Holman’s injury in barely one month’s time.
