Lawsuit Filed Against Shalev Senior Living, Inc. for Wrongful Death
Garcia, Artigliere & Medby filed a lawsuit against Shalev Senior Living, Inc. for elder abuse, assault and battery, and wrongful death. The lawsuit alleges that Josef Halevi suffered from unprovoked assault and battery from the facility’s employees, resulting in his death.
In 2013, Mr. Halevi was admitted to the facility because his family was no longer able to provide him the care and assistance he needed at home. Mr. Halevi suffered from severe Alzheimer’s with Sundowner’s syndrome, was unable to walk or talk and required assistance for all daily living activities. The facility staff was well aware that Mr. Halevi was at a high risk for assaults and needed special, 24-hour care.
Upon moving to Shalev Senior Living, Mr. Halevi was anxious due to the new environment, and in addition had some physical altercations with a facility caregiver. As a result, Mr. Halevi was prescribed medication and ceased physical altercations with caregivers for the time being. However, his former spouse, Marianne Halevi, often visited, finding the facility to be understaffed with only one or two caregivers for six residents, all with Alzheimer’s and/or Sundowner’s syndrome. Mrs. Halevi asked the facility and owner on many occasions to hire more staff to provide the required care of all residents. In 2014, Mrs. Halevi paid a visit to her former husband only to find him making strange noises. She then took it upon herself to place a recorder in his room to capture the noises in order to play the recording for his physician.
After leaving the audio recorder in Mr. Halevi’s room, Mrs. Halevi heard the facility caregivers yelling at and beating Mr. Halevi. Shalev Senior Living tried to cover up the assault and sought to fraudulently conceal Mr. Halevi’s injuries from both the Department of Social Services and his family. Unfortunately, as a direct result of the insufficiency of facility staff, Mr. Halevi did not receive the required protection he needed and passed away on December 30, 2014.
“The ignorance of Shalev Senior Living and its caregivers was a reckless disregard for the health and safety of Mr. Halevi,” says attorney Stephen Garcia. “The unfit staff led to the improper withholding of required medical services to prevent him from suffering injury and eventual death.”
