Golden Living Center in Fresno Sued for Elder Abuse
Garcia & Artigliere filed a lawsuit against Golden Living Center for elder abuse, negligence, and negligent hiring and supervision. The lawsuit alleges that Abelardo Suarez suffered from severe pressure ulcers and injury that required surgery as a result of the facility’s negligence.
“The facility and staff disregarded Mr. Suarez’s needs,” says Attorney Stephen Garcia. “They wrongfully withheld the proper services required by law, and he suffered because of it.”
In late 2012, Mr. Suarez was transferred from St. Agnes Medical Center to Golden Living Center, both in Fresno, after being treated at the hospital for diabetic leg wounds that became infected. Upon admission into the facility, Mr. Suarez was wheelchair-bound and required assistance with all activities of daily living, including eating, grooming, toileting and transferring.
Both the facility and staff were well aware of Mr. Suarez’s circumstance and that he suffered from a sedentary nature as the result of his severe diabetic condition. Staff members failed to provide Mr. Suarez with proper care, including: failing to regularly clean him; providing proper hygiene; ensuring that he was repositioned every two hours to relieve pressure sores; providing adequate nutrition and hydration; properly evaluating his condition; and complying with physicians’ orders.
Mr. Suarez’s needs were constantly ignored by the facility and its staff members. Multiple times, he requested a urinal so he could urinate, but staff members failed to provide it to him. As a result, Mr. Suarez would urinate on himself and then be left to sit in his soaked diaper and clothes for hours. On several occasions, staff members deprived Mr. Suarez of basic necessities like food, claiming that they “forgot”.
On September 10, 2015, Mr. Suarez developed an avoidable pressure ulcer as a result of the facility’s negligence. The ulcer became so severe and infected that Mr. Suarez was taken to the emergency room, where he underwent a painful surgical procedure.
