Garcia & Artigliere Recognized by Daily Journal for Obtaining Largest Elder Abuse and Dependent Adult Civil Protection Act Settlement in California History
EADACPA case named to Daily Journal’s Top Verdicts by Dollar List
Partners Stephen Garcia and Bill Artigliere, along with J. Clancey Bounds of Bounds Law Group, were recognized by Daily Journal for obtaining a $36.8 million settlement in an Orange County court for the Plaintiff in relation to the care she received while she was a patient at a hospital and suffered a stroke. This result was named as the top overall settlement in Daily Journal’s list of Verdicts by Dollar and is considered to be the largest Elder Abuse and Dependent Adult Civil Protection Act settlement (EADACPA) in California history.
The Plaintiff contended that while she was at the defendant’s hospital, she suffered from a stroke and the hospital’s Code Stroke policy was not implemented as she was being treated in the emergency room for over eight hours. Additionally, when she was transferred to the Intensive Care Unit, the physician in charge of that unit reviewed her chart but failed to evaluate or see her. The Plaintiff claimed that the physician left her solely to the resident staff, who were limited by their level of training. As a result, the Plaintiff contended that the major delay in diagnosis of her stroke left her in a state where she cannot move any extremity, cannot consume food by mouth and cannot speak.
