Garcia, Artigliere & Medby Obtains $1.6M Wrongful Death Judgment
Garcia, Artigliere & Medby obtained a $1.6 million judgment against Jobertson’s Management Services, Inc. and Mirabel by the Sea III. The lawsuit was originally filed on behalf of the family of Tomasina Labella for elder abuse, negligent hiring and supervision, fraud and wrongful death.
In 2013, Labella was admitted to Mirabel by the Sea III due to a myriad of health conditions, including dementia, osteoporosis and hypertension. However, rather than providing the care they promised and were paid for, the facility neglected Labella. As a result of the facility’s carelessness, Labella suffered urinary tract infections, pneumonia, four falls, broken ribs, a broken ankle and a substantial weight loss of more than 50 pounds.
After Labella fell several times, the facility attempted to “chemically restrain” her by sedating her so much that she was almost comatose. Tragically, Labella was treated so poorly and neglected so frequently that it resulted in her untimely death.
