Garcia, Artigliere & Medby Files Lawsuit Against Vista Cove at Arcadia for Elder Abuse and Negligence
Garcia, Artigliere & Medby filed a lawsuit against Vista Cove at Arcadia and parent facility Vista Cove Senior Living, LLC for elder abuse, negligence, negligent hiring and supervision, and fraud on behalf of Henry Hennes.
The lawsuit alleges that Mr. Hennes suffered multiple, preventable falls during his stay at Vista Cove, received improper medications that worsened his medical condition, was “thrown” back in bed after his falls and was falsely informed that he had suffered no injuries. Once the family of Mr. Hennes transferred him to another hospital, it was determined that he had broken his hip after his last fall at Vista Cove. In addition, the lawsuit alleges the facility failed to document any falls or injuries Mr. Hennes sustained while under their care, as well as understaffed and undertrained their facility, causing increased likelihood of harm to its residents.
“Vista Cove at Arcadia has violated multiple laws and treated Mr. Hennes horribly, causing him to suffer a great deal of preventable pain,” said Stephen Garcia of Garcia, Artigliere & Medby. “Further, during pre-admission evaluation, the facility was clearly advised of Mr. Hennes’s tenancy to wander, therefore requiring special assistance and 24-hour supervision. It’s obvious they completely ignored these important instructions for financial gain.”
