Garcia, Artigliere & Medby Files Lawsuit Against Villa Las Palmas Healthcare for Elder Abuse and Wrongful Death
Garcia, Artigliere & Medby filed a lawsuit against Jeffrey Pine Holdings, LLC dba Villa Las Palmas Healthcare and Plum Healthcare Group, LLC for elder abuse, negligence, fraud and wrongful death on behalf of Ruth Brittain.
The lawsuit alleges that upon Ms. Brittain’s arrival at the facility in 2012, Villa Las Palmas Healthcare had vast knowledge of her history of prior falls and her propensity to wander, yet withheld the required special care and monitoring assistance to prevent future incidents. Ms. Brittain suffered three separate falls in the facility, the last of which resulted in a hip fracture requiring surgery. During recovery, she developed debilitating pressure sores and suffered from multiple urinary tract infections, extreme weight loss and severe infections in her mouth and gums. These injuries ultimately led to her death.
“The defendants flat out ignored the known needs of Ms. Brittain day in and day out,” said Stephen Garcia of Garcia, Artigliere & Medby. “They simply accepted the notion that Ms. Brittain was going to pass one day, so they might as well collect her money and provide her the lowest level of care. This horrific behavior will not be tolerated.”
