Fullerton Healthcare & Wellness Center Sued for Elder Abuse, Negligence & Fraud

Garcia, Artigliere & Medby filed a lawsuit against Fullerton Healthcare & Wellness Center for elder abuse, negligence, negligent hiring and supervision, and fraud. The lawsuit alleges that Floyd Wiley, Jr. suffered several injuries from multiple falls and pressure sores on his heel, leg and tailbone due to gross negligence on the part of the nursing care facility.

“Mr. Wiley’s injuries could have been avoided. Fullerton Healthcare & Wellness Center admitted him with full knowledge of his ailing medical condition, and the specific care he required. Yet, they completely ignored their responsibility to provide the necessary care to Mr. Wiley and he suffered the consequences,” says attorney Stephen Garcia.

In 2013, Mr. Wiley was admitted to the facility battling a myriad of major medical issues. These issues made him extremely susceptible to the development of pressure sores and related infections. He was also prone to falls if not generally supervised or handled correctly during transfers in and out of bed and into wheelchairs. Given Mr. Wiley’s litany of health problems, nursing staff failed to implement his physician’s mandated care plan, which included regular movement and repositioning to avoid pressure sore development. Additionally, the facility did not keep Mr. Wiley under constant supervision, nor implement safety provisions such as “lap buddies” (a warning device alerting bystanders that a wheelchair bound individual has fallen) and wheelchair hip guards, which would have prevented him from falling.

As a result of the facility’s negligent care, Mr. Wiley fell out of his wheelchair and sustained a cut requiring 13 stitches. On a separate occasion, he fell out of bed, sustaining an injury that impaired his vision. He was also dropped from a Hoyer lift on several occasions, and was denied any injury assessment or subsequent medical treatment. Furthermore, he developed severe pressure sores on his heel, leg and tailbone that were left untreated and allowed to grow into festering infected ulcers.

Fullerton Healthcare & Wellness Center did not adequately attend to Mr. Wiley’s personal hygiene and failed to provide him with proper nutrition, which contributed to his ulcers, festering infections and his general decline in health.
