ABC News Features Stephen Garcia Discussing Lawsuit Against San Joaquin Valley Rehab Hospital for Elder Abuse and Sexual Assault
As featured on ABC News, Garcia, Artigliere & Medby filed a lawsuit against San Joaquin Valley Rehab Hospital, its parent company Vibra Healthcare, LLC, and Hospital administrator Edward Palacios, as well as numerous staff members alleging elder abuse, negligence, negligent hiring and supervision, fraud, assault and battery on behalf of patient Mary Haven. The lawsuit alleges the Hospital failed to report the sexual assault of Mrs. Haven by a certified male nurse who was known to have poor performance issues and dangerous propensities.
“To have something like this happen is bad enough, but then to cover it up, that’s where you take it to a level of institutional wrongdoing,” said Partner Stephen Garcia.
Mr. Garcia added that Mrs. Haven has no memory problems, but she is experiencing nightmares and she would rather forget the entire incident. She is filing the suit to protect other patients at the Hospital.
“Mrs. Haven and her family are absolutely adamant that this doesn’t happen to anyone else,” he said.
