The elder abuse attorneys at Garcia & Artigliere have filed suit against Roscoe Corp and Quality Health Services Corporation for financially motivated understaffing and neglect.

After undergoing surgery for a fall-related hip fracture, an 83-year old woman checked into Roscoe Corp, hereafter known as ‘the facility,’ for rehabilitative care. Within one month, she had developed a catheter-associated UTI and lost 25 pounds. At the insistence of her family, the woman was placed on an air mattress to relieve pressure. From there, she suffered a fall out of bed and was transported to West Hills Hospital.

At the hospital, doctors discovered a massive, stage IV pressure sore, also known as a decubitus ulcer or bedsore, on the patient’s coccyx area. The wound was open, infected, and had a 2-3-inch diameter, thus exposing the client’s tailbone. The patient had to undergo vacuum-assisted closure and an extremely painful skin graph surgery. Her infection was treated with antibiotics, but she fears she will never walk again.

This injury, in conjunction with the client’s dehydration, dietary neglect, and lack of sanitary care while at the facility, have caused a decline in her overall health. The abuse and neglect she suffered at the hands of the facility was entirely preventable and could have been avoided with proper staffing.

According to the lawsuit, the organization had a plan to cut costs, which ultimately led to its chronic underfunding and understaffing. Facility revenues were siphoned for personal profit by its management, who used the nursing home as a “shell company.” While the client’s injuries were developing, management continued advertising to the general public.

Garcia & Artigliere are pursuing general damages, special damages, and punitive and exemplary damages on behalf of the client. Fact finders will be asked to find the facility liable of negligent hiring and the violation of a myriad of state and federal rules, laws, regulations, and codes.

The case has been filed to the Superior Court of the State of California County of Los Angeles and is currently in active litigation.
