Community Care Rehab Center, LLC operates as a long-term custodial care facility in Riverside, California under the fictitious business name “Community Care & Rehabilitation Center.” The complaint alleges that the plaintiff, Booker Laster, Sr. (90), suffered injuries, neglect, and abuse because the defendants purposely understaffed the facility, siphoned exorbitant amounts of cash resources for non-clinical “phantom services,” and failed to train and supervise their employees.
The Community Care & Rehabilitation Center was responsible for providing the plaintiff with 24-hour custodial care services between March and August of 2018. Due to his advanced age and preexisting conditions, Laster relied on the nursing home employees to fulfill his basic daily needs, including turning and repositioning, dressing and grooming, medication management, and toileting assistance. Instead, the staffers neglected Laster to the extent that he developed severe infections, including pneumonia, and Stage IV pressure sores (bedsores). Furthermore, the defendants violated California’s nursing home laws by concealing Laster’s medical condition from his family, physician, and/or legal representative, and by failing to transfer him to a medical facility that is equipped to treat his ailments.
