Elder Abuse Claim Filed Against The California Home for the Aged, Inc. by Garcia & Artigliere
LONG BEACH, CA — August 30, 2019 — Garcia & Artigliere is representing the family of an elderly woman who died as a result of the abusive and neglectful conditions that are present in The California Home for the Aged, Inc.
The California Home for the Aged is a facility located in Fresno, CA. The victim in this case was transferred to the nursing home following a hospitalization at Saint Agnes Medical Center, for a major heart attack. The victim was required to use a feeding tube during her time in the hospital, and was moved to the Home for the Aged as a step in rehabilitation.
Due to her condition, the victim was highly at risk for developing pressure sores (or “bed sores”). Pressure sores are skin and tissue injuries that can result if a patient is stationary for extended periods of time. In late stages, bed sores can progress into severe infections, which can be deadly. The risk of developing severe bed sores increases in non-hygienic settings.
The staff at The California Home for the Aged was aware of the victim’s risk of developing pressure sores. When she moved in, she already had a sore that she had sustained during her stay at Saint Agnes Medical Center. Despite their knowledge of this risk, the facility’s care providers failed to initiate the proper procedures — such as shifting her position frequently and cleaning her wounds and living area — that could have prevented the existing sore to progressing to the level that it did.
The bed sore the victim had developed in the hospital worsened into an open, infected wound. Nursing home staff hid the victim’s deteriorating condition from her family, doctors, and legal counsel. She was eventually transferred to Fresno Community Hospital to the infection, which had advanced to a stage of septic shock. She died a few days later as a result.
