Garcia & Artigliere Represents Elder Woman Abused & Assaulted in Negligent Nursing Home
Garcia & Artigliere filed a lawsuit against Marna Health Services Inc. on behalf of an elderly woman who was sexually abused, physically assaulted, and neglected while in their care.
Attorney Stephen M. Garcia of Garcia & Artigliere filed a lawsuit against Marna Health Services, Inc. Friday, August 2, on behalf of his client, an elderly woman who was sexually abused, physically assaulted, and neglected while receiving care at one of their facilities. The plaintiff suffered physical abuse from the nursing home staff, including a punch to the stomach and blows to her head. In the complaint, the plaintiff asks for compensation for damages for elder abuse, the facility’s negligent hiring and supervision, and assault and battery.
The suit alleges that the defendant was, by law, obligated to follow all state and federal laws governing nursing home facilities, including those that enforce proper licensing of the facility and employees, responsible hiring, and supervision of residents. However, in the case of our plaintiff, the Marna Health Services, Inc. facility was negligent in their hiring practices, which exposed residents to poor and dangerous “care.”
When the plaintiff reported the abuse to her family, the facility denied her claims and began to deny her necessary care within the facility, which resulted in additional injuries. She was also sexually abused by one of the staff members, and in response to the incident, the staff relocated her to another healthcare facility without properly reporting the incident. The facility also did nothing to dismiss or report the staff member who assaulted her. By the time the plaintiff’s family was notified, she had already been moved.
The facility, Hillcrest Nursing Home, was advertised as a 59-bed, 24-hour Skilled Nursing Facility able to provide both long-term and custodial care. However, it has since been discovered that Hillcrest Nursing Home is a fictitious business name, though the facility is owned and operated by Marna Health Services, Inc., a California corporation.
