Garcia & Artigliere File Elder Abuse Complaint Against Negligent Nursing Home Facility
Attorneys Stephen M. Garcia and William M. Artigliere of Garcia & Artigliere have filed a complaint against C.P.C.H., Inc. and North American Healthcare, Inc. on behalf of a client who suffered elder abuse while in their care.
The lawyers at Garcia & Artigliere are representing a plaintiff’s lawsuit against C.P.C.H., Inc and North American Healthcare, Inc. based on two causes of action: elder abuse and negligent hiring and supervision practices. C.P.C.H., Inc. operated a long-term custodial care facility in Chatsworth, California under the fictitious business name “Chatsworth Park Care Center.” North American Health Care, Inc. served as the owners and operators of this facility, which was responsible for providing 24-hour care to the plaintiff, Renee Ghazale (65), between April and July of this year.
The complaint alleges that the facility and its management put vulnerable residents – specifically, the plaintiff – in danger by failing to train and supervise their employees. North American Health Care, Inc. is also being held legally accountable for purposely underfunding and understaffing the facility with the intent of maximizing its daily profits. Consequently, the facility staffers lacked the educational background, training, and resources to provide a reasonable level of care to the plaintiff.
During her stay, the plaintiff suffered preventable head and orthopedic injuries from serious falls, as well as debilitating bedsores on her coccyx. The facility failed to properly notify her family and physician about these incidents and injuries, which is a policy required by state and federal laws. The plaintiff’s family didn’t know about their loved one’s condition until she was assaulted and transferred to Northridge Hospital on July 8, 2019. There, plaintiff received treatment for physical trauma, including blunt force head trauma, a broken arm and nose, and a busted lip.
