Napa Valley Register Reports on Lawsuit Against Local Care Facility

As published in Napa Valley Register, Garcia & Artigliere filed a lawsuit against a now closed residential care facility on behalf of Atha Jo Mallare for elder abuse and negligent hiring and supervision. While at the facility Mallare suffered from multiple pressure sores and had bruises on her body, all of which were concealed by the facility’s staff.

Mallare was admitted to A Hidden Knoll in August 2016 after it became difficult for her to live on her own due to her dementia. She and her family believed that the facility would provide the care she needed. According to the lawsuit, Mallare’s family found her with her hands tightly bound with a piece of plastic and a bedsheet twisted around her wrists. Both of her hands were swollen purple and she smelled of urine.

During her stay at A Hidden Knoll, Mallare lost more than 30 pounds and wasn’t able to eat on her own, walk or hold a conversation with family; she also developed pressure sores and her dementia worsened. Although the facility advertised that they provided care for residents with dementia, the facility was apparently understaffed and not properly trained.
