Patient Assaulted at Los Angeles Nursing Facility

Los Angeles, Calif. — After being hospitalized as a result of high blood sugar, Barbara Jones was sent to New Vista Nursing & Rehabilitation Center for rehabilitation, as well as 24-hour care and assistance. Unfortunately, New Vista Nursing & Rehabilitation Center failed to provide Barbara the care she required and in which they promised to provide to protect her from known health and safety hazards, and most specifically, the known aggressive tendencies of other facility residents. The result of this blind eye led to the unfortunate and preventable sexual assault of Barbara by the facility staff.

“Barbara was admitted to the facility for monitoring and supervision that would keep her safe from the ever-present danger of sexual assaults,” said attorney Stephen Garcia. “Not only did the facility fail in providing for the health and safety of Barbara, they fostered and nurtured an environment which led to these horrific events.”

Garcia & Artigliere filed a lawsuit against New Vista Nursing & Rehabilitation Center for elder abuse, negligent hiring and supervision, and assault and battery. The lawsuit alleges that Jones was admitted into the facility in 2015 for assistance with all activities of daily living. Jones suffered from dementia, short-term memory loss, diabetes and was unable to walk and therefore protect herself from unwanted assaults.

The lawsuit alleges that as the result of the environment of misconduct and neglect in New Vista Nursing & Rehabilitation Center, Jones was sexually assaulted. And in fact, the lawsuit alleges she unwillingly developed a sexually abusive relationship with several staff members that were known to have sexual vices. It is also alleged that unfortunately, this unmitigated pattern of abuse persisted and Jones’ family would often find cuts and bruises on her and would complain to the facility’s staff, but nothing was ever done to protect Jones’ safety.
