Another Lawsuit Against Golden Living Center for Elder Abuse

Stockton, Calif.—Golden Living Center – Hy-Pana was obligated to care for Cloridia Toliver as she recovered from recent hip surgery. Instead, they neglected her and did not properly treat her wounds, which ultimately led to the development of a severe staph infection.

“Cloridia checked into the facility for care and rehabilitation of her hip,” said Attorney Stephen Garcia. “What she received was neglectful treatment, resulting in numerous injuries, and health and safety hazards as a result of the facility’s inadequate care.”

Garcia & Artigliere filed a lawsuit against Golden Living Center – Hy-Pana for elder abuse, negligence, and negligent supervision. After a recent fall and fractured hip, Toliver was admitted to the facility for rehabilitation. Upon her admission, both the facility and staff were aware of Toliver’s history of falls, the need to monitor her blood cell count and assist her with all activities of daily living.

The staff withheld care from Toliver by leaving her in her urine and feces for extended periods of time; failing to provide adequate assistance; failing to reposition her; and denying her proper evaluation of her conditions.

On March 8, 2016, the stitches fell out of the wound from Toliver’s hip surgery, causing it to reopen. Instead of notifying her family or physician, the facility took photos and covered the wound with gauze. Two days later, Toliver had an appointment with her physician, and when he discovered the wound, he ordered her to be discharged from the facility.

There were several other occasions when Toliver was transferred between the hospital and the facility in attempts to deal with new illnesses that had developed. Toliver was later informed that she had MRSA that had developed from the reopened wound, which led to breathing problems, chest pains and a blood clot in her lung.

As a result of the Golden Living Center – Hy-Pana’s neglect, Toliver has to undergo further treatment for the conditions she developed at the facility.
