Torrance Care Center West Sued for Elder Abuse, Negligence and Fraud
Garcia & Artigliere filed a lawsuit in Los Angeles Superior Court accusing the management and staff of Torrance Care Center West of abusing and withholding care from an elderly woman, Lola McIntyre, who suffered a broken hip and shoulder as a result of the facility’s negligence.
“Lola had suffered a series of tragic medical ailments, and her family members were led to believe they found a facility that could provide her adequate care,” said Attorney Stephen Garcia. “However, the staff and administration abused her by reckless neglect, providing an inexcusably poor level of care.”
In September 2015, Ms. McIntyre was admitted to Torrance Care Center West. The staff at the facility was well aware that she was suffering from several medical conditions, including a recent heart attack, a stroke, dementia, bipolar disorder, schizophrenia, severe arthritis and much more. She was also taking several medications to help with these conditions, including Ambien and Seroquel, both of which can be disorienting. Ms. McIntyre’s serious medical conditions in combination with the drugs she was taking left her at a high risk of falling. The staff was fully aware not only of Ms. McIntyre’s medical conditions, but also that she had a history of wandering off at night when not being supervised. Ms. McIntyre’s daughter had provided explicit warnings about this to the Director of Nursing. Unfortunately, the facility and its staff members disregarded the instructions regarding the care Ms. McIntyre required, and as a result, she suffered greatly.
The staff and owners knew they were unable to provide proper care for Ms. McIntyre, and as a result of being left unattended on a regular basis throughout her stay at Torrance Care Center West, Ms. McIntyre broke multiple items in her room, wandered throughout the facility, and at one point nearly started a fire. Even after being made aware of how dangerous the situation was for Ms. McIntyre, the facility did nothing to change her care plan and furthermore committed fraud by covering up the incidents.
On December 7, Ms. McIntyre fell out of her wheelchair, resulting in a broken hip and shoulder. However, the staff ignored her cries about being hurt in the fall and just put her back into her wheelchair and then later to bed. She spent all night in bed severely injured and asking for help, but her family and physician were not notified about the incident until the next morning.
“Ms. McIntyre was only in this facility for a few months before she fell and broke several bones,” added Garcia. “Her poor treatment was covered up, her family was kept uninformed and all the while this poor woman was treated as nothing other than profit.”
