Patient Dies at Kaiser Permanente Baldwin Park Due to Negligence
Garcia & Artigliere filed a lawsuit against Kaiser Permanente Baldwin Park Medical Center for elder abuse, negligence, and negligent hiring and supervision of one of its patients, Wah Choi Lau. The lawsuit alleges that the medical center and staff severely neglected Mr. Lau, causing him to suffer an entirely preventable fall that resulted in a fatal brain hemorrhage.
“The hospital and staff were well aware that if they failed to provide Wah Choi with the required care, supervision and monitoring necessary, there was a high probability he could suffer an injury,” said Attorney Stephen Garcia. “Despite the hospital’s awareness of this, Wah Choi did not receive sufficient care and monitoring, resulting in a severe injury that eventually caused his death.”
On June 5, 2015, Mr. Lau complained of a stomach ache and a lack of appetite, and his son accompanied him to the emergency room at Kaiser Permanente Baldwin Park Medical Center. Mr. Lau was told he would have to spend the night for testing related to his complaint of a stomach ache.
The staff was well aware of the many health issues Mr. Lau suffered from, including underactive thyroid, high blood pressure, acid reflux, glaucoma and osteoporosis. Additionally, Mr. Lau could only walk with the aid of a walker, therefore making him a high risk for falls when left unattended.
Later in the day, Mr. Lau’s son left the medical center to get something to eat. About an hour later, Mr. Lau’s granddaughter received a phone call indicating that Mr. Lau had suffered a fall; however, no other details were provided to her. Staff members informed his granddaughter that no injuries were sustained. Later that night, Mr. Lau’s granddaughter was again contacted by the center’s staff saying they needed to strap down Mr. Lau because he was moving too much and there were not enough staff members present to watch him.
His granddaughter went to the center to find out what was happening and discovered that Mr. Lau had a swollen and bruised eye and a neck brace, and was lying in a position where his feet were elevated, causing blood to rush to his head. As a result of the medical center wrongfully withholding required care to Mr. Lau, he suffered from internal bleeding in the brain and had to be sent immediately to their intensive care unit in Fontana. Although his granddaughter tried to keep him awake, Mr. Lau went into a coma and never regained consciousness.
At almost midnight, Mr. Lau was admitted to Kaiser Permanente Fontana Medical Center’s intensive care unit. A nurse indicated that his clothing was soiled, further proving the neglect he had suffered at Kaiser’s Baldwin Park hospital. Early in the morning on June 6, 2015, an x-ray of Mr. Lau’s brain was examined and his family was notified that it was already halfway filled with blood.
On June 7, 2015, Mr. Lau passed away as a result of the negligence and abuse he sustained at Kaiser Permanente Baldwin Park Medical Center.
