Woman Suffers Broken Shoulder as a Result of L.A. Facility Negligence
Garcia & Artigliere filed a lawsuit against City View Villa located in Los Angeles, California, for elder abuse, negligence, and negligent hiring and supervision. The lawsuit alleges that the facility neglected Louise Macklemore, causing her to suffer a severe fall that resulted in a broken shoulder.
“A fact well known to the facility is that elders with dementia, such as Louise, have a propensity to wander, and are at high risk of suffering falls and injury,” says Attorney Stephen Garcia. “Instead of updating Louise’s care plan to prevent her from falling, the facility consciously disregarded this known risk, which resulted in a severe shoulder injury.”
On February 12, 2016, Ms. Macklemore began residing at City View Villa because her daughter could no longer care for her at home. While living at home, Ms. Macklemore suffered several falls resulting in injury, which was one of the main reasons for her admittance into the facility.
Ms. Macklemore has severe dementia and a propensity to wander, and was on multiple psychiatric medications. While at City View Villa, she required complete supervision and assistance with all activities of daily living and was categorized as a high risk for falls.
Ms. Macklemore suffered multiple falls at the facility. In spite of this, the staff failed to update her care plans to prevent future falls and concealed the fact that she had already fallen multiple times while in their care. Predictably, the falls continued unabated until Ms. Macklemore fell in mid-March and broke her shoulder when she was left unattended and tried to get out of bed to use the restroom. It was not until later that day she was found alone on the bathroom floor complaining about pain in her shoulder. She was in so much pain that she would not allow any staff to touch her arm.
The facility notified Ms. Macklemore’s daughter about the fall, but instead of calling 911, they instructed the daughter to seek medical attention for her mother on her own. In the days following Ms. Macklemore’s fall, she remained at City View Villa without receiving any medical care or treatment. Her condition continued to decline; she began to lose her appetite and eventually stopped eating.
On March 26, 2016, more than one week after she fell and broke her shoulder, Ms. Macklemore was found unresponsive. She was finally taken to Cedars Sinai Medical Center, where she was assessed and it was reported that she had low blood pressure and was malnourished and dehydrated.
The facility also collected and retained an additional month’s rent from Ms. Macklemore in the amount of $2,000 even after it became clear that her condition could not warrant a second admission into the facility.
