Lawsuit Filed Against Palos Verdes Health Care Center for Elder Abuse

Garcia & Artigliere filed a lawsuit against Allelo & Associates and Amnon Licht, doing business under the fictitious business name Palos Verdes Health Care Center, for elder abuse, negligence, and negligent hiring and supervision. The lawsuit alleges that Palos Verdes Health Care Center purposefully withheld care from Maria Renteria, which led to a fall resulting in fractures to both Mrs. Renteria’s legs.

“As a result of total negligence, Palos Verdes Health Care Center allowed Mrs. Renteria to break both of her legs, and then refused to do anything about it. Mrs. Renteria was left to languish in terrible pain for nearly 24 hours. Such misconduct on the part of this nursing care facility is unconscionable,” says attorney Stephen Garcia.

In 2012, Mrs. Renteria was admitted to Palos Verdes Health Care Center after a fall at home that resulted in a leg fracture, following subsequent inpatient rehabilitation that failed to restore her complete mobility. Mrs. Renteria was wheelchair bound and required assistance to move in and out of her wheelchair.

Upon admission, Palos Verdes Health Care Center was made aware that Mrs. Renteria was at a high risk for falls and required regular assistance. On the morning of Friday, August 21, 2015, Mrs. Renteria requested assistance to move from her bed into her wheelchair, and a facility nursing assistant denied the request. Mrs. Renteria attempted to move herself, but fell, crushing both legs beneath her. She cried out in excruciating pain at the fall, to which the nursing assistant responded “shut up” and left Mrs. Renteria on the floor for an hour before helping her into her wheelchair.

After Mrs. Renteria complained throughout the day about leg pain, facility staff contacted her daughter that evening. The facility insisted nothing had happened, but Mrs. Renteria told her daughter about her fall. After the daughter’s repeated and strident requests, over a period of several hours, the facility finally acquiesced and transferred Mrs. Renteria to a hospital. X-rays showed spiral fractures in both of Mrs. Renteria’s legs, an injury the attending physician attributed to a hard fall.
