Four Lawsuits Filed Against Knolls Convalescent Hospital

Garcia & Artigliere filed its fourth lawsuit against Spring Valley Post Acute LLC, Knolls Convalescent Hospital and Meridian Management Services, LLC for elder abuse, negligence, negligent hiring and supervision, and fraud. The lawsuit alleges that Thomas Blackburn, Jr. suffered multiple falls, pneumonia and a severe infection due to the gross negligence of the facility.

“This is the fourth lawsuit brought against this facility. Their continued negligence and complete disregard for their residents is alarming,” says attorney Stephen Garcia. “They continue to place their residents in harm’s way, such as Mr. Blackburn, for the sole purpose of financial gain.”

In September 2014, Mr. Blackburn was admitted to the facility for rehabilitation and physical therapy after undergoing back surgery. It was well known to facility staff that he was a fall risk patient; however, the facility did not supervise or monitor his daily activities, failed to competently train their staff to assist Mr. Blackburn and denied the provision of safety and assistance devices to prevent him from suffering further falls. After Mr. Blackburn’s initial falls, the facility attempted to cover up the existence and occurrence of such falls. As a result of the multiple falls, he suffered lacerations, contusions and a horrible black eye.

Additionally, the facility neglected to monitor Mr. Blackburn’s food intake and outtake, or report the nature, content and color of his urine to his physician, which would have detected his infected surgical incision in its early stages. Furthermore, facility staff refused to put a clean bandage on the incision when his wife requested they do so. During a follow-up appointment with Mr. Blackburn’s surgeon, the surgeon took one look at his condition and requested his wife take him to the hospital immediately, where he was diagnosed with pneumonia and an infection.

The facility withheld the required care to accurately and properly implement Plans of Care that would have prevented Mr. Blackburn from developing pneumonia, especially when it was clear that the Plans in place were inadequate.
