Sixth Lawsuit Filed Against Meridian Management for Elder Abuse

Garcia & Artigliere

Garcia, Artigliere & Medby filed a lawsuit against Spring Valley Post Acute, a 24-hour skilled nursing facility operating as Knolls Convalescent Hospital, on behalf of Rudolph Wallachy, an 87-year-old patient who suffered abusive treatment at the hands of the facility’s staff. The facility, which its managers and owners operate as a money-making venture, has been sued for similar allegations multiple times prior.

The complaint alleges that the facility’s staff failed to provide Mr. Wallachy with the most basic level of care, causing him to develop avoidable pressure ulcers. Caretakers, some of whom were unlicensed, did not perform simple necessary tasks, such as providing Mr. Wallachy with adequate nutrition and hydration, turning him in his bed to relieve pressure, and keeping him clean and dry. On several occasions, Mr. Wallachy was left lying in urine and feces for an extended period of time.

“Mr. Wallachy was treated without consideration for his comfort and dignity,” says attorney Stephen Garcia. “His basic medical needs were wholly ignored and he suffered preventable consequences. Not only are the defendants’ actions deplorable, but they also fly in the face of state and federal regulations.”

Caretakers were aware of Mr. Wallachy’s high infection risk upon his entrance to the facility, yet placed him with roommates who had open sores and infections. When Mr. Wallachy’s family questioned this decision, the staff falsely asserted that there was no infection risk. The staff later threatened the family, telling them that if they did not accept the facility’s level of care, they were going to ship Mr. Wallachy away and that whatever happened to him “would be on them.”

Management was aware that the facility was understaffed and underfunded, yet they continued to misrepresent their services and admit patients, knowing they could not provide them with the proper level of care. Their goal was simply to fill beds and maximize profits.
