Fifth Lawsuit Filed Against Meridian Management for Wrongful Death

Garcia & Artigliere filed its fifth lawsuit against Spring Valley Post Acute LLC, Knolls Convalescent Hospital and Meridian Management Services LLC for elder abuse, negligence, negligent hiring and supervision, fraud and wrongful death. The lawsuit alleges that the facility failed to administer required interventions to protect Roger Barden Jr. from health and safety hazards, causing him to suffer preventable falls, ultimately resulting in his death.

“This facility blatantly ignored the laws and failed to provide the proper care to Roger,” says attorney Stephen Garcia. “He, nor any reasonable person, would have agreed to become a resident at such a facility if the true facts had been known prior to his admission.”

In May 2015, Mr. Barden was transferred to the Spring Valley Post Acute facility after being treated for pneumonia at Desert Valley Hospital. Upon his arrival, it was evident that Mr. Barden was extremely weak and frail. Staff members were well aware that Mr. Barden was a fall risk patient and one of the primary responsibilities was to protect him from falls. The facility ensured Mr. Barden’s family that they would implement care plans to prevent falls, provide 24-hour supervision, assist with ambulation and monitor all activities of daily living. However, staff members consciously disregarded these risks and failed to provide Mr. Barden with the required care, directly leading to his injuries and eventual death.

After being a resident at the facility for only a few weeks, Mr. Barden suffered an open wound on his head from another fall. The staff failed to immediately send him to the hospital, and he became unresponsive. Mr. Barden failed to regain consciousness and died later that day.

The withholding of required services was the result of Meridian Management’s plan to cut costs at the expense of their residents. The facility understaffed and under trained employees as a mechanism to reduce labor costs. They had knowledge of the unlawful conduct and business practices, yet represented to the public and Mr. Barden that they would provide proper care that met legal standards.
