Garcia & Artigliere Files Lawsuit Against Geri Care V, LLC
Garcia & Artigliere filed a lawsuit against Geri Care V, LLC, dba Desert Oasis Healthcare and Antelope Valley Healthcare, and its corporate officers and directors for elder abuse, negligence, negligent hiring and supervision, and fraud on behalf of their client Arcelle Thomas.
The lawsuit alleges that the defendants wrongfully withheld services from Ms. Thomas that resulted in the development of multiple pressure sores and dehydration. Additionally, the facility concealed these injuries from Ms. Thomas’ daughter, personal caregivers and her physician.
“This facility flat out ignored the needs of Ms. Thomas and tried to cover it up several times demonstrating they cannot be trusted with caring for the elderly,” says attorney Stephen Garcia. “Her injuries were completely preventable and were never reported to her family or physician.”
On February 27, 2015, Ms. Thomas was transferred to the facility for rehabilitation and physical therapy for a pelvic fracture and a lower back injury she sustained from a fall at home. The facility’s directors and employees were well aware of her injuries and neglected to provide the care she required, such as assistance for all activities, body repositioning and ensuring she was clean, dry and properly hydrated in order to prevent the development of pressure sores.
Ms. Thomas’ daughter and two private personal caregivers visited her every day and never witnessed her outside of the bed. They only witnessed Ms. Thomas in physical therapy one time during her 12-day residency.
On March 10, 2015, Ms. Thomas was discharged from the facility and complained that her behind area hurt. The next day, one of Ms. Thomas’ personal caregivers gave her a bath, where she again complained of pain on her behind. The personal caregiver discovered a bloodied bandage on Ms. Thomas’ backside covering up multiple open wound pressure sores.
As a result of Ms. Thomas’ pressure sore injuries and dehydration, she is unable to walk and is in severe pain.
