Garcia & Artigliere File Lawsuit Against Palmdale Regional Medical

Garcia & Artigliere filed a lawsuit against Palmdale Regional Medical Center on behalf of Eckard Nichols for dependent adult abuse, negligence, negligent hiring and supervision, and fraud. The lawsuit alleges that Mr. Nichols developed a baseball-size infected pressure sore on his coccyx as a direct result of the hospital’s neglect and understaffing.

“Palmdale appears to have participated in a fraudulent scheme to cover up Mr. Nichols’ injuries in order to sustain their stream of income from MediCare,” says attorney Stephen Garcia. “Had Palmdale upheld their legal obligation and filed reports of his injuries with the Department of Public Health, their MediCare funding as to Mr. Nichols would likely have been revoked.”

On March 21, 2015, Mr. Nichols was admitted to Palmdale Regional Medical Center. Upon admission, Mr. Nichols’ skin was free and clear of pressure sores. Hospital staff was well aware of Mr. Nichols’ medical history and high risk of developing pressure sores if not properly cared for. However, within the first 24 hours of his stay, Mr. Nichols was left to lay on a hard gurney and was only turned/repositioned once, which was in violation of the hospital’s policies and procedures.

Mr. Nichols was constantly left unattended and unbathed, which led to the development of an open bleeding pressure sore. Mr. Nichols’ wife demanded Hospital staff call in a wound care nurse to examine and treat the sore; however, the nurse came, viewed the sore, and left without treatment.

On April 5, 2015, Mr. Nichols was treated for pneumonia; however, Hospital staff continued to neglect him, and as a result, his pressure sore worsened to a painful baseball-size infected sore that exposed his muscle and bone.
