Garcia & Artigliere Files Lawsuit Against Manor Care of Fountain Valley
Garcia & Artigliere filed a lawsuit against Manor Care of Fountain Valley (Manor Care), a residential skilled nursing facility, on behalf of Arlayne Hoover for elder abuse, negligence, negligent hiring and supervision, fraud and wrongful death. The lawsuit alleges Ms. Hoover was grossly neglected under Manor Care’s care and supervision and suffered from a leg fracture, which ultimately led to her death.
“This is the second lawsuit we’ve filed against Manor Care Fountain Valley for elder abuse resulting in the death of a patient. It certainly appears that their severe lack of care is a pattern and too many patients have, and will continue to suffer,” says lead attorney Stephen Garcia. “This lawsuit will hopefully shed light on their unfortunate practices.”
Prior to Ms. Hoover’s stay at Manor Care, she suffered from falls at home and was subsequently diagnosed with cancer in her left leg. In November 2014, Ms. Hoover was transferred to Manor Care to rehabilitate from surgery on her left leg. Manor Care was well aware of Ms. Hoover’s medical history of suffering from falls, scoliosis, osteoporosis and a brittle left leg, which required 24-hour supervision and monitoring of daily living.
On two occasions, Ms. Hoover pleaded for assistance to the restroom and was blatantly ignored. As a result, she suffered a fall and sustained a fracture to her left leg. Manor Care not only never performed any neuro checks but also failed to inform her physician, a blatant disregard of their own protocol and policies in place.
After Ms. Hoover’s leg was splinted, she returned to Manor Care where she continued to receive substandard care and supervision. Upon her arrival, she became increasingly disoriented and confused. Manor Care reported to her family that she now requires around the clock care and would be transferred to their long-term care section.
The lack of care continued, and Ms. Hoover was left soiled in bed with feces on her hands and dehydrated. On January 9, Manor Care placed Ms. Hoover in hospice care, where she died on January 15, 2015.
