Elder Abuse May Include Stealing
One of the scariest things that can happen to a person when they age is to suffer from elder abuse. In a recent Livermore, California, case it became clear that the court doesn’t just view physical harm or neglect to qualify for the definition of elder abuse anymore. Stealing money from elderly – which could have the potential of leaving elderly people without means to provide themselves with food, housing, medicine, and other necessities – can also qualify as abuse.
In one case, a bank employee will not only have to reimburse his employer for the $118,000 he stole from a 91-year-old man suffering from dementia, but the employee will also have to serve jail time. This was after the defense thought they had worked out a deal in which their client would have to reimburse the bank and face a stealing charge. Instead, the judge stated that what really happened qualified as elder abuse.
If you or a loved one has suffered or is suffering from elder abuse, Garcia & Artigliere can help. We have spent years successfully helping victims as we practice elder abuse law. Elder abuse can be physical abuse, sexual abuse, emotional and psychological abuse, and of course theft that can leave an elderly person humiliated and destitute. If you are concerned that someone you love may be suffering from elder abuse, some of the signs to look for include:
- Sudden and increasing stress
- Anxiety about different things; sometimes everyday things can seem stressful
- Withdrawal from family and friends and change in behavioral patterns
- Strange behavior
It is important for loved ones to investigate reasons for these changes in behavior or increased anxiety. Offer to sit down and go over bills, receipts, and bank statements with the person you’re concerned about. It is not uncommon for an elderly person who has taken great care of their own finances for decades to be embarrassed if they know they have been taken advantage of. It is also not uncommon for the elderly to trust one person too much and not know they have been taken advantage of until the thief is gone, or the money has been spent and is difficult to get back.
