Resident Alleges OC Residential Care Facility Refused to Treat Injuries

Garcia & Artigliere filed a lawsuit on behalf of Cherry Myers against Tiffany’s Board and Care III, located in La Habra, for elder abuse, negligence, negligent hiring and supervision, and fraud. The lawsuit alleges Ms. Myers suffered an avoidable pressure sore on her tailbone and went untreated for her scabies infection for several months. Further, the facility concealed the scabies outbreak, as well as concealed that they lacked the necessary license to properly take care of Ms. Myers’ feeding tube in order to collect monies.

In December 2014, upon admission to the facility, Ms. Myers suffered from dementia, anemia, and visual impairment, and could not speak. The facility’s staff was aware that Ms. Myers required special assistance with daily activities and was at high risk for developing pressure sores. Additionally, the defendants admitted Ms. Myers to the facility with a feeding tube, despite lacking the necessary license to do so.

While the facility was aware of Ms. Myers’ need, Tiffany’s Board and Care III failed to implement skin interventions to prevent pressure sores, which included turning and repositioning her body every two hours, ensuring she was clean, dry and free from feces, and providing her with sufficient nutrition. Additionally, the facility concealed that its staff and other residents were being treated for scabies, and did not properly diagnose or treat Ms. Myers for her severe scabies infection for months.

“The facility was not licensed to accept Ms. Myers as a resident and fraudulently took her money for personal gain,” says attorney Stephen Garcia. “The facility was well aware of the danger to their staff and patients, but consciously disregarded the law.”
