Bakersfield Healthcare Center Sued for Elder Abuse and Fraud

Garcia & Artigliere filed a lawsuit against Bakersfield Healthcare Center for elder abuse, negligence, negligent hiring and supervision, and fraud. The lawsuit alleges that Rosetta Moreno suffered from pneumonia and severe pressure sores the size of a baseball on her tailbone due to the negligence of the facility.

“Ms. Moreno’s injuries were absolutely avoidable; however, Bakersfield Healthcare ignored their responsibility to provide her the required care she needed,” says attorney Stephen Garcia.

Ms. Moreno depended on the facility to assist her with daily activities, since she was unable to care for herself on her own. The facility did not provide her with proper nutrition and was observed on several occasions taking food from other residents’ trays because she was so hungry, resulting in her losing 60 pounds in a four month time span.

When family members notified the facility about her ill condition, they brushed it off and said she was fine. Subsequently, one of Ms. Moreno’s daughters visited her and noticed she was extremely hot, sweating and was having trouble breathing. She requested the facility take Ms. Moreno to the hospital; however, they refused to take her until the next day.

Ms. Moreno was admitted to the ICU for pneumonia that was overlooked and untreated while she was at the facility. Additionally, the hospital discovered she suffered from severe pressure sores the size of a baseball on her tailbone.
