Garcia & Artigliere filed a lawsuit on behalf of their 83-year-old client Rose Marie West against Sign of the Dove, The Breakers of Long Beach and its corporate officers for elder abuse, negligence, negligent hiring and supervision, fraud and wrongful death. The lawsuit alleges The Breakers of Long Beach wrongfully withheld care from Ms. West, resulting in a skin sore with a severe staph bacterial infection that ultimately led to her death.

“The facility purposefully withheld information from Ms. West’s daughter on her mother’s condition in order to save face,” says attorney Stephen Garcia. “It is the facility’s responsibility to ensure their patients are safe and taken care. This facility’s outrageous behavior cost Ms. West her life.”

In late 2013, Ms. West was admitted to the facility because she was unable to care for herself at home. Upon admission, she suffered from a history of throat cancer, trouble swallowing and Alzheimer’s Dementia. The facility and its staff were well aware that Ms. West required repositioning of her body, to be clean at all times and fed nutritional meals. Additionally, she required mobility assistance and had difficulty eating.

In January 2014, Ms. West’s daughter was informed by the facility doctor that her mother suffered from a hole on her left leg that was infected with a bacterial staph infection. When she confronted the facility staff, they had no knowledge of the injury. Ms. West was transferred to the hospital for treatment.

On several occasions, Ms. West’s daughter visited her mother and witnessed that her mother was not fed or medicated, cockroaches crawled out of dresser drawers and on the walls, and more.

Ms. West’s daughter repeatedly confronted them about the lack of care, yet the facility and its staff never took action to ensure Ms. West was safe and well taken care of. Due to the continued lack of care, Ms. West passed away on January 22, 2015.
