Garcia & Artigliere Files Lawsuit Against A&R Living in Mission Viejo

Garcia & Artigliere filed a lawsuit against A & R Living, Inc. (A & R) dba Adriana’s Senior Care Living, Administrator Richard Mendoza, Jr. and Assistant Administrator Adriana Mendoza for elder abuse, negligence, negligent hiring, and supervision, as well as fraud on behalf of Antoinette Gallardo. The lawsuit states that the facility, located in Mission Viejo, withheld the proper care causing Ms. Gallardo severe health issues and that the facility was severely understaffed and undertrained.

“A & R did not fulfill their promise and duty by law to properly care for Ms. Gallardo,” said Stephen Garcia of Garcia & Artigliere. “Within three months at the facility, Ms. Gallardo’s health had visibly deteriorated, and A & R not only neglected Ms. Gallardo on every account but grossly delayed treatment when she was very sick. She is lucky to be alive.”

Ms. Gallardo was admitted to A & R in October 2014 with preexisting conditions, including diabetes, moderate dementia, and incontinence of bladder. A & R was fully aware of her conditions and the fact that she required special care and attention.

On January 4, 2015, Ms. Gallardo was admitted to a hospital where she was diagnosed with kidney failure, dehydration, and sepsis and had E. coli bacteria in her urine. It was also apparent she had not been bathed in weeks as her hands, teeth, and fingernails were filthy. She lost more than 50 pounds since her admission to A & R.

In addition to the injuries sustained at A & R, the lawsuit alleges that the facility’s staff waited several days to administer a prescribed bacteria-fighting medication to Ms. Gallardo, and gave no explanation for the delay. Further, the facility and its staff kept improper records of the medication, including no expiration date, date filled or date started.

Throughout the duration of Ms. Gallardo’s stay at A & R, her family noticed that the shower chair she had brought to receive proper showers had not been opened and the required Hoyer lift needed to transfer her from bed to shower had not been acquired by the facility. These observations conclude that A & R neglected to provide the necessary care to Ms. Gallardo.
