The claim asserts that Holiday Retirement, one of the nation’s largest operators of “independent senior retirement communities,” aggressively markets and advertises to war veterans that becoming a resident of one of their communities will assist the war veterans in qualifying for and obtaining the enhanced pension benefit known as Aid & Attendance. However, because it is alleged that nearly all Holiday Retirement communities are “independent living communities” which do not offer assisted living, nursing or similar services, living in a Holiday Retirement community cannot and does not help a war veteran to qualify for Aid & Attendance. The claim asserts that as a result of Holiday Retirement’s misleading advertisements and marketing, many war veterans became residents, paid Holiday Retirement’s high monthly rent payments, and then ended up owing Holiday Retirement thousands of dollars in back rent when their Aid & Attendance benefits were denied by the government.
