The Federal Trade Commission

The Federal Trade Commission (FTC) is the main federal agency enforcing consumer protection laws. The FTC uses what they call “industry guides” and trade regulations to define what is an “unfair or deceptive” trade practice. Enforcement may be done via administrative proceedings, lawsuits or FTC rulemaking power. The FTC has enforcement powers for many consumer laws including:

  • The Fair Credit Reporting Act (FCRA)
  • The Truth in Lending Act (TILA)
  • The Fair Credit Billing Act
  • The Fair Debt Collection Practices Act (FDCPA)
  • The Magnuson-Moss Warranty Act
  • The Identity Theft and Assumption Deterrence Act of 1998 (ITADA)

State Enforcement

State laws also protect consumers. All states have common law (judge-made law) giving protection against fraudulent business practices. To prove consumer fraud, you must usually prove that:

  • The person doing business with you made a false statement of “material fact” (a fact that was important in your transaction).
  • The person making the statement knew or believed the statement was false.
  • You relied on the false statement to your detriment .

In many states, the common law has been compiled into state consumer protection laws. Your state attorney general often provides enforcement and may have a “consumer affairs department.”

Private, volunteer groups, such as the Better Business Bureau (BBB), also receive consumer complaints and conduct investigations on abusive business practices. These groups can encourage businesses to abide by consumer protection laws and help settle consumer disputes.
